A group of 32 senators has moved to overturn the controversial mercury rule the Bush Administration adopted in March. The new rule, as finalized by the Environmental Protection Agency (EPA), exempts power plants from the strict regulations on emissions established by the Clean Air Act, which if put into effect would reduce mercury emissions an estimated 90% by 2008. Under the new rule, however, such plants could participate in an industry-favored cap-and-trade program that would not go into effect until 2010 and which would reduce emissions to 70% of current emissions in 2018.

Sen Patrick Leahy (D, Vt) filed a discharge petition on July 18, which would force a vote on whether to overturn the mercury rule.
