Compensation for Vaccine Injury-Reply

In Reply.—

Dr Bader makes some excellent points. The AMA Commission on Vaccine Injury Compensation has shared many of his concerns, as has the American Medical Association Council on Legislation.

Consequently, the AMA draft legislation states that "if a claimant within 60 days notifies the secretary of objection to a decision made by the Office of Vaccine Injury Compensation, there shall be a prompt agency hearing and adjudication in accordance with Section 554, Title V, United States Code." A second level of appeals exists in the US Court of Appeals for the District of Columbia if the secretary's final order in disposition of a claim is thought to be inadequate. The Council on Legislation felt that this recourse would protect the interests of the claimant and, at the same time, avoid the inherent disadvantages in the tort system.
