The Council on Scientific Affairs carefully examined the scientific literature on alcohol-impaired driving and found what it considered persuasive evidence that significant numbers of drivers are impaired at a BAC of 0.05%. That evidence is cited in the COUNCIL REPORT.

Contrary to Dr Hjelle's belief in "society's tolerant attitude toward drunk driving," the Council also found persuasive evidence in the literature to document a societal attitude that is evolving toward less tolerance of alcohol-impaired driving and more demand for effective laws, effectively enforced. The Council recommendations regarding BAC reflect the need to support the societal loss of tolerance. It should be noted that the Council specifically did not cite any "safe" levels of drinking for drivers: the chief recommendation in the Council report is that drivers should not drink.
